Welcome to Aura Swap. By accessing or using our service, you agree to be bound by these Terms of Service ("Terms"). Please read them carefully.

1. Acceptance of Terms

By creating an account or using Aura Swap ("Service"), you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. Description of Service

Aura Swap provides AI-powered face swapping technology that allows users to replace faces in videos with their own likeness. The Service is provided on a subscription basis with a credit system.

3. Eligibility

You must be at least 18 years old to use Aura Swap. By using the Service, you represent and warrant that you meet this requirement.

4. Account Registration

You must provide accurate and complete information when creating an account
You are responsible for maintaining the security of your account credentials
You are responsible for all activities that occur under your account
You must notify us immediately of any unauthorized use of your account

5. Subscription and Payments

Pricing: Subscriptions are billed at $17.99 per month
Credits: Each subscription includes 6,000 credits per billing cycle
Credit Usage: Credits are consumed at a rate of 10 credits per second of processed video
Unused Credits: Credits do not roll over between billing periods
Billing: Subscriptions automatically renew unless canceled
Payment Processing: All payments are processed securely through Stripe

6. Cancellation and Refunds

You may cancel your subscription at any time through your account settings
Upon cancellation, you retain access until the end of your current billing period
Refunds are provided at our sole discretion and are not guaranteed

7. Acceptable Use Policy

You agree NOT to use the Service to:

Create content depicting minors in any context
Create non-consensual intimate imagery of any person
Impersonate others for fraudulent purposes
Create defamatory, harassing, or threatening content
Violate any person's privacy rights or personality rights
Create content that infringes on copyrights, trademarks, or other intellectual property
Generate content promoting violence, hate speech, or illegal activities
Circumvent any technical limitations or security measures

Important: You must have the right to use any faces and videos you upload. Using someone else's likeness without their consent may violate laws in your jurisdiction.

8. Content Ownership and Rights

Your Content: You retain ownership of content you upload and create
License to Us: By uploading content, you grant us a limited license to process it for providing the Service
Output: You own the face-swapped videos you create, subject to underlying rights
Responsibility: You are solely responsible for ensuring you have rights to use uploaded content

9. Intellectual Property

The Service, including its design, features, and technology, is owned by Aura Swap and protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service.

10. Privacy and Data

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee uninterrupted or error-free service
Processing times and quality may vary
We are not responsible for content created by users

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AURA SWAP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our total liability for any claims under these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless Aura Swap and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service or violation of these Terms.

14. Termination

We may suspend or terminate your account for violation of these Terms
We may discontinue the Service at any time with reasonable notice
Upon termination, your right to use the Service ceases immediately

15. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by email or through the Service. Continued use after changes constitutes acceptance of the new Terms.

16. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.

17. Dispute Resolution

Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in court.
